How to Actually Collect After Winning a Judgment

A court judgment is a legal paper proving debt, but the court does not collect the money for you. You must take affirmative post-judgment collection steps.

Order for Appearance and Examination (Debtor's Exam): Subpoena the defendant to court under oath to disclose their bank accounts, employer, real estate, and vehicle titles.

Bank Levy: Take a Writ of Execution to the defendant's bank branch. The sheriff freezes and transfers non-exempt funds directly to satisfy your judgment.

Wage Garnishment: Direct their employer to withhold up to 25% of the debtor's disposable weekly earnings until the judgment plus post-judgment interest is paid in full.

What is the dollar limit in small claims court?

Limits vary by state: California is $12,500 for individuals ($6,250 for corporations); Texas is $20,000; Florida is $8,000; New York is $5,000–$10,000 depending on city/town; Georgia is $15,000. If your claim is slightly above the cap, you can choose to waive the excess amount to remain in speedy small claims court.

Can I bring an attorney to small claims court?

In some states (CA, MI, NE), lawyers are strictly banned from representing clients in small claims trials (unless the lawyer is representing themselves). In other states, lawyers are permitted, but judges expect concise, informal presentations without technical evidentiary objections.
