Modifying an Existing Child Custody Order

Material Change in Circumstances: To modify an existing court-ordered custody arrangement, you must prove that a substantial and material change in circumstances has occurred since the last order was signed.

Examples of Material Change: Relocation/job transfer, child's age and developmental needs, a parent's remarriage or changed work schedule, or evidence of neglect/instability in the home.

Emergency Modifications: If a child is in immediate danger of physical harm or abuse, file an Ex Parte Emergency Application for Temporary Custody with supporting police reports or child welfare records.

What does 'Best Interests of the Child' mean?

It is the universal legal standard family courts use to make custody rulings. Judges evaluate factors including: the child's emotional bond with each parent, parental stability and mental/physical health, child's school continuity, any history of domestic violence or substance abuse, and which parent is more likely to encourage a healthy relationship with the other parent.

Can I stop visitation if the other parent doesn't pay child support?

No. In every U.S. jurisdiction, child support and visitation are legally separate issues. Denying court-ordered visitation because child support is delinquent can result in you being held in contempt of court or even losing custody.
